Terms and Conditions



By making a reservation with Yambulla you are confirming that you and all persons named in your reservation, have read, understood and accepted these Terms and Conditions. If there is anything would like to clarify please let us know before confirming your reservation.



How to book

To make a reservation send us an email (jim@yambulla.com.au). We will answer any questions you have then direct you to an online booking form.

All parts of the booking form must be completed for your reservation to be confirmed.

Payments can be made with a credit card securely online or over the phone. If you do not wish to pay by credit card please contact us to discuss other options. Bookings are not confirmed until a deposit has been received.


Currency

All prices are in Australian dollars (AUD$).


Payment terms

To make a reservation more than 60 days before the scheduled Experience date a $500 deposit is required.

The balance is payable no less than 60 days before your arrival date.

If you are making a reservation 60 days or less before the scheduled Experience date full payment is required.


Room configuration

Places on our experiences are limited to a maximum of 8 guests. All our rooms are double or twin occupancy. You need to advise us at the time of booking what configuration of rooms/beds is required. If you are travelling on your own a single supplement does apply.


Pricing

Prices are quoted per person for each Experience. Please refer to the Experience page on our website for the rates and what is included and excluded in this price.

Group rates are available, please ask.

Extra costs such as beverages and airport pick-up/drop-off are billed at end of stay. Contact us for quotes.


Cancellation by guest

The $500 per person deposit is non-refundable.

Cancellations are allowed for any reason up until 30 days before your arrival date. Any amounts paid (less the $500 deposit) will be refunded.

Cancellations for any reason less than 30 days before your arrival date are non-refundable.

All cancellations must be notified in writing. The date of cancellation is the date we receive your email confirming that you wish to cancel.

Non-arrivals or early departures are non-refundable. This includes non-arrivals or early departures due to special circumstances such as injury, illness or bereavement. Travel insurance and medical insurance are strongly recommended to cover you in these instances.


Cancellation by Yambulla

Yambulla reserves the right to cancel any Experience without reason up until 60 days before the scheduled arrival date. Any amounts paid will be refunded.

Due to our remote location and the outdoor nature of our Experiences there may be circumstances in which we will need to cancel or change an Experience at short notice to ensure the safety and wellbeing of our guests and guides.

Yambulla reserves the right to cancel or change any Experience, at any time prior to arrival, due to natural disasters, weather conditions or any events or circumstances that make it unviable or unsafe for Yambulla to operate our planned schedule. In these circumstances we will do our best to reschedule. If the rescheduled dates do not work for you a full refund will be issued.

Yambulla will cancel all Experiences in the event of Extreme Fire conditions (or higher) for the area, as prescribed by the RFS.

Yambulla will not be responsible for reimbursing cost of flights, accommodation, hire car, meals or any other incidental costs which may be incurred in relation to cancelled Experiences. Travel insurance is therefore strongly recommended to cover these expenses.

Yambulla reserves the right to alter the itinerary of any Experience as required to ensure the safety and well-being of our guests and guides.


Special offers

From time to time our Special Offers and Promotions may have differing cancellation terms. In this case, cancellation terms specified in your booking confirmation will override the ones described here.


Suitable clothing and footwear

Please read the ‘what to pack’ recommendations on our website and be guided accordingly. Yambulla cannot accept responsibility for injury, discomfort or inability to participate in activities due to a guest not having appropriate footwear or protective clothing.


Reasonable care

We expect that you will take good care of our property during your stay. Missing items or damage to structure or contents deemed to have been caused by a lack of reasonable care may result in additional charges being added to your bill. Reasonable care includes but is not limited to following fire and safety rules, water and power conservation and septic tank guidelines that will be provided on your arrival.


Travel insurance

We recommend you take travel insurance to cover both your stay and your travel to and from Yambulla. Please check that your policy provides cover against personal accidents or injury, medical expenses, emergency repatriation, personal liability, loss or damage to personal belongings, and cancellation for any reason including bereavement, illness or delayed flights.


Privacy policy

Yambulla will keep your details private. Any information, we collect in relation to you is kept strictly secured. We do not pass on, sell or swap any of your personal details with anyone. We use this information to identify your needs and to provide you with a more comfortable experience.We will ask you to provide some basic information about yourself such as your name, mailing address, phone number, credit card details and dietary requirement so we can contact you and process your booking.


Dietary requirements

We do our best to design our menus to accommodate allergies, dietary needs and preferences. This can only be done if information is provided in advance. Any requests for dietary needs/preferences cannot be guaranteed unless information is provided in detail on the booking form at time of reservation.


COVID Policy

Yambulla will take all possible precautions before and during your stay to reduce the risk of exposing our guests and experts to potential COVID-19 infection.

The Yambulla team are fully vaccinated against COVID-19 and regularly tested. In order to provide a safe environment for our guests, our team and our local community, we can only accept guests who are also fully vaccinated against COVID-19.

You must notify us of any contact you may have had with any COVID-19 infected person or any visits to known ‘hot spots’ prior to arriving at Yambulla.

Yambulla reserves the right to cancel your reservation or send you home early if we think that you might be infectious.

Any person displaying symptoms including headache, cough, sore throat, temperature or fatigue will be isolated and may be asked to leave.

Strict hand-washing and sanitising rules will apply. Anyone not co-operating will be asked to leave.

Experiences will be cancelled if government recommendations or restrictions for group gatherings apply.

In the case of cancellations due to potential COVID-19 infection or government recommendations or restrictions a full refund will be given of any money paid to Yambulla. In this circumstance we cannot cover any other costs you have incurred such as travel. Please make sure your travel insurance covers you for these expenses.


Yambulla Exclusion and Indemnity Contract

‍We require that all guests sign our indemnity form on arrival. Please note that signing the form is a prerequisite of visiting Yambulla and participating in our Experiences.
The wording of the Indemnity you will be required to sign is included here for you reference:

Signing the contract

We (Yambulla) require all guests to sign this Exclusion & Indemnity Contract on arrival.  Please note that signing the form is a mandatory prerequisite of visiting Yambulla and participating in our Experiences and upon signing, this form will constitute a contract between us and is subject to the law of New South Wales, Australia.

Warning

We (the guest/s) acknowledge and agree that Yambulla Experiences include activities which involve both obvious and inherent risks to our personal safety and I/we agree that my/our participation in such Experiences is at my/our own risk.

Activities

For clarity the parties acknowledge that the following activities involve will be undertaken and shall be considered recreational activities where permitted by law and for the purposes of this Exclusion & Indemnity Contract it is noted that such activities involve both obvious and inherent risks:
Riding in/driving motor vehicles including side by side 3 seater and 6 seater Polaris UTVs Hiking across farmland and bushland-guided and unguidedBeing on or near tractors and related farm machinery (no chainsaw use by guests)Being in or near waterwaysBuilding structures in waterwaysBeing near campfiresBeing near wildlife including venomous snakes, spiders and other creatures which inhabit the Australian bushSpending the night in movable outdoor shelters

Exclusion & Indemnity

(a) In consideration of JD Osborne (the Company) trading as Yambulla accepting my/our application to participate in a Land management Experience in and around Yambulla I/we agree to indemnify  and to forever keep indemnified, to hold harmless and to make good the Company, its servants and agents or any of them to the maximum extent permitted by the law from and against all costs, claims, actions, demands, suits or liability whatsoever and howsoever arising or in any way connected with my/our participation in a Yambulla Experience (including without limitation transport to and from the area in which the Experience is to take place) and whether or not arising as a result of negligence, breach of contract, trespass, breach of statutory duty or otherwise on the part of the Company, its servants and agents or any of them.

(b) Where the Company cannot lawfully exclude liability, its liability to you is limited, at the Company’s choice to:

(i) A further supply of an Experience at no charge, or
(ii) A refund of the cost paid to the Company for an Experience.      

(c)  Notwithstanding any other provision of this contract the limitation of liability and indemnity contained herein shall not apply to any liability arising as a result of, or in connection with:

(i) Fraud or wilful misconduct by the Company; or
(ii) Breach of privacy by the Company.

(d) To the fullest extent permitted by law, the Company excludes all warranties implied by law except as expressly set out in this contract.
